Please read these Terms and Conditions (“Terms”) carefully before using the National Center for Construction Education and Research (NCCER) website, the Build Your Future (BYF) website, the NCCER Instructor Toolbox, the NCCER learning platform, the NCCER testing system, the NCCER mobile app, the CareerStarter website, the CareerStarter mobile app, the CraftPro mobile platform, or any other website, learning platform, or mobile application controlled or operated by NCCER (the “NCCER Sites”).
Your access to and use of the NCCER Sites and NCCER Content (as defined herein) are conditioned on your acceptance of and compliance with these Terms. These Terms apply to all users and/or others who access or use the NCCER Sites and NCCER Content.
By accessing or using the NCCER Sites and/or the NCCER Content, you agree to be bound by these Terms. If you disagree with any part of these Terms, you should not access the NCCER Sites or the NCCER Content.
User Account
If you are the owner of an account and/or login credentials on the NCCER Sites, you are solely responsible for maintaining the confidentiality of your private user details (username and password). You are responsible for all activities that occur under your account or password.
NCCER reserves all rights to terminate accounts and login or similar access credentials, to edit or remove any and/or all content, and to cancel orders or similar requests in its sole discretion.
Compliance with NCCER Standards
You agree to abide by and remain in compliance with all policies and procedures of the most current version of the NCCER Accreditation Standards for Training and/or the NCCER Accreditation Standards for Assessments (“NCCER Standards”), as applicable, which are published at the Resources and Forms page of the NCCER website, and may be revised from time to time.
Credential and Certification Data
You authorize NCCER and the NCCER accredited organization(s) where you receive training or testing to store, access and utilize your personal information in association with your training and/or assessment records. Further, you authorize NCCER to rely upon this information to maintain your training and/or assessment records in its secure credential database.
You release and hold harmless NCCER from any and all liability resulting from (i) its reliance on personal information you provide, (ii) disclosing your name, NCCER number and training and/or assessment records in the NCCER Online Verification portal to any user with access to your NCCER number, or (iii) disclosing such information when required to do so by law or court order.
You confirm your understanding that any and all NCCER credentials and/or certifications you are granted may be revoked by NCCER at any time, with or without notice, at NCCER’s sole discretion. You also understand and agree that NCCER shall have no legal, financial, or other liability to you for the revocation of any certification or credential, and that financial liability for any funds you may have paid to an organization for training, testing, or other services associated with the issuance of such certifications or credentials shall rest solely with said organization.
NCCER Content
The content in the NCCER Instructor Toolbox, the NCCER Sites, Online Courses (e.g. CraftPro), Module Tests, Assessments, Performance Profiles, Performance Verifications (PVs), Practical Examinations, and any other materials developed by NCCER (“NCCER Content”) and the trademarks, service marks, and logos appearing in the NCCER Content (“NCCER Marks”) are owned by NCCER or licensed to NCCER, and are subject to copyright, trademark, and other intellectual property rights under United States and foreign laws and international conventions. NCCER Content includes, without limitation, all source code, metadata, databases, functionality, software, website designs, audio, video, text, photographs, and graphics. All NCCER graphics, logos, designs, page headers, button icons, scripts and service names are registered trademarks, common law trademarks or trade dress of NCCER in the United States and/or other countries. The NCCER Marks may not be used, including as part of trademarks and/or as part of domain names, in connection with any product or service in any manner that is likely to cause confusion, and may not be copied, imitated, or used, in whole or in part, without the prior, express written permission of NCCER.
Financial Terms
The purchase of subscriptions for any NCCER product, including Module Test Subscriptions and CraftPro course subscriptions, is non-refundable. As stated on the NCCER pricing page, subscriptions should be purchased and assigned to learners before any testing begins to avoid incurring per-test fees. NCCER will not issue account credits for unused subscriptions that were not assigned before testing. When an organization has a credit balance on its account, that credit will be automatically applied to future invoices. In NCCER’s billing portal, organizations may opt-out of automatically applying credits to invoices; this would allow billing contacts the ability to apply credits manually when paying invoices in the billing portal. All credits shall expire 2 years from the date of issuance unless otherwise agreed in writing by NCCER. Upon the expiration of a credit, the amount of any remaining unused credit will be converted to a donation to NCCER. NCCER shall have no further obligation, financial or otherwise, to the customer or any other party for expired credits.
NCCER reserves the right to suspend any organization or user account with invoices that are more than 30 days delinquent. If an account is delinquent multiple times, NCCER may require a customer to pre-pay to retain continued access to NCCER systems and resources. If any check or payment is returned for any reason, NCCER may apply a fee equivalent to that charged by its financial institution, or a $25 returned check fee, whichever is greater, to the customer’s account. NCCER reserves the right to require a counter or cashier’s check on any account with a history of delinquent or returned payments.
Disclaimer of Liability
ALL NCCER CONTENT ON NCCER SITES IS PROVIDED TO YOU “AS IS” FOR YOUR INFORMATIONAL AND PERSONAL USE ONLY AND MAY NOT BE USED, COPIED, REPRODUCED, AGGREGATED, DISTRIBUTED, TRANSMITTED, BROADCAST, DISPLAYED, SOLD, LICENSED, OR OTHERWISE EXPLOITED FOR ANY OTHER PURPOSES WHATSOEVER WITHOUT THE PRIOR WRITTEN APPROVAL OF NCCER, PROVIDED THAT YOU ARE AN AUTHORIZED PURCHASER AND/OR OTHERWISE AUTHORIZED TO USE THE NCCER CONTENT. CERTIFIED NCCER INSTRUCTORS ARE GRANTED A LIMITED LICENSE TO USE THE NCCER CONTENT AVAILABLE IN THE INSTRUCTOR TOOLBOX AND TO DOWNLOAD OR PRINT A COPY OF ANY PORTION OF SUCH CONTENT TO WHICH THEY HAVE PROPERLY GAINED ACCESS SOLELY FOR THEIR PERSONAL, NON-COMMERCIAL USE. NCCER RESERVES ALL RIGHTS NOT EXPRESSLY GRANTED TO YOU IN AND TO THE NCCER CONTENT AND THE NCCER MARKS.
Changes
NCCER reserves the right, at our sole discretion, to modify or replace these Terms at any time. We will notify you of any changes by posting the new Terms on this page.
If a change in these Terms is material, we will provide notice by email and/or a prominent notice on our Terms, prior to the change becoming effective, and we will update the “effective date” at the top of these Terms and Conditions. What constitutes a material change will be determined at our sole discretion. Unless otherwise noted, changes to these Terms and Conditions shall be effective when they are posted to this page.
